This Privacy Policy applies to those who visit the websites owned and operated by GeoZilla, download any downloadable software, install any mobile applications, and/or use the Company’s products and services offered at www.geozilla.com (collectively, the “GeoZilla Service”). This Privacy Policy describes how GeoZilla collects, uses, shares and secures the personal information of the users of GeoZilla Service (the “User(s)” or “you” or “yours”, as applicable). It also describes your choices regarding use, access and correction of your personal information.

Personal Information

Personal Information is any information that can be used to identify, locate, or contact an individual (the “Personal Information”). This includes data directly tied to a person, like their name, email address, phone number, as well as indirect identifiers, like an IP address, device identifiers, or location data when combined with other details. Personal Information does not include aggregate information. Our Privacy Policy does not restrict or limit our collection and use of aggregate information.

Personal Information Collection

When you use GeoZilla Service, we may collect and process following Personal Information about you:

Information you provide for the use of GeoZilla Service

  • Registration and Profile Information.

    When you create an account, we may collect your Personal Information such as your username, name, email address, mobile phone number and a photo, if you choose to have a photo associated with your account.

    If you want to add family member to your account, we collect such family member’s name, email address, and mobile phone number.

    We may also collect additional information from a parent or legal guardian in order to obtain verifiable parental consent to allow a child to use the GeoZilla Service.

  • Payments.
    When you sign up for GeoZilla Premium, we may collect certain billing information, including the last four digits of your card, card brand, and payment receipts to confirm your subscription status. Full payment details, like complete card information, are handled directly by the payment providers, which may include the app store or a third-party payment processor as described below. We do not store your full payment details.
  • Messages. We collect information when you message other members of your family through the use of GeoZilla Service.
  • Contacts: We may process certain contact details, such as the phone numbers of people you invite to GeoZilla Service when you select the “invite via phone number” option, as well as the phone numbers of individuals you designate as your SOS contacts. Please ensure you have a lawful basis for sharing this information with us before doing so.
  • Inquiries: When you contact GeoZilla support team with a request, we process the content of your inquiry, including any attached files (if any), and your contact information depending on the method of communication you use (e.g., your name and email address).
  • Newsletters: We may use your email address to send you updates, special offers, and discounts related to GeoZilla Service.

Automatically collected information

  • Device and Usage information

    When you use the GeoZilla Service, we and our business partners may collect certain information about your computer or device through widely used technologies like cookies, web beacons, log files, and other tracking tools. Please note that these methods are standard practice across most digital services and platforms to help ensure functionality and improve user experience.

    Such information includes:

    • Information about your device such as IP address, browser information, brand and model of the device, device identifier, operating system and version, time zone, language settings, screen resolution, general location, network settings, battery level and charging status,
    • Information about your use of GeoZilla Service such as referring/exit pages and URLs, click stream data, interaction with links on the GeoZilla Service, landing pages, page views, cookie data that allows us to uniquely identify your browser, browsing behavior on our site, error logs.

      This information is collected to (i) ensure the proper delivery of GeoZilla services, (ii) analyze performance and track errors for reliability and troubleshooting, and (iii) understand user preferences to adapt the service and updates accordingly.

    • Advertising Data. We may work with third-party advertising networks, social media platforms, and other services to deliver advertisements and content that may be relevant to your interests. These partners may collect certain information about your interactions with the GeoZilla Service over time, across devices, and in combination with data from other sites, apps, and services. This data could include information about your device (as described above), advertising identifiers, clickstream details, hashed email addresses, browsing behavior, and other similar information. By gathering this information, these partners can tailor ads for relevance across websites, apps, and devices you use.
    • Location. We collect your location through GPS, WiFi, or wireless network triangulation to provide the GeoZilla Service. This data is used to offer key features such as real-time geofence alerts and location sharing with members you choose to share your location with. While you are logged into your account and have location services enabled, we will continue to collect and process your location data to provide the services.
    • Driving Event Data: GeoZilla Service collects data from your mobile device’s sensors, including accelerometer, gyroscope, GPS, and Bluetooth, to monitor driving events. The data includes changes in speed or direction, location data to track vehicle speed and position, and Bluetooth data to identify when the device is connected to the car system. This information helps detect unsafe driving behaviors like speeding, hard braking, and sudden impacts.
    • Fall Detection Data: GeoZilla Service includes a fall detection feature that uses data from your device's sensors, including the accelerometer, gyroscope, and location data, to detect sudden impacts or falls. This information helps identify rapid changes in movement or orientation, such as a sudden drop or abrupt stop, that may indicate a fall. In case a fall is detected, we may notify emergency contacts or provide alerts based on your preferences.

Data We Receive from Third Parties

When you register in GeoZilla Service using social media platforms, such as Facebook, we receive certain information from the social network. This may include your profile information, profile picture, gender, username, user ID associated with your social media account, age range, language, country, and any other details you allow the social network to share with third parties. The specific data we receive depends on your privacy settings with the social network.

Except as set out in this Privacy Policy, your Personal Information will not be used for any other purpose without informing you first by updating this Privacy Policy. We do not sell any Personal Information to third parties.

Children’s Privacy

GeoZilla allows parents to keep track of their children’s location on mobile devices that the parent has added to their account. The service is intended to be used by children under 13 only with parental approval. In the European Union (EU), the service is intended for children under 16 only with parental consent, in accordance with applicable data protection laws.

If a parent wishes to add a user who is under 13 (or under 16 in the EU) to the family account, the parent or legal guardian must send GeoZilla parental consent via email. The child’s Personal Information will be shared with other members of the family account. GeoZilla may then use the child’s Personal Information as described in this Privacy Policy.

However, we do not use or share Personal Information collected from the accounts of children under 13 (or under 16 in the EU) for marketing or advertising purposes, nor do we permit our third-party partners to collect and use such information for advertising purposes.

If you believe that we might have inadvertently collected information from a child under 13 (or under 16 in the EU) without parental consent, please contact us immediately.

Integrated IoT Partners

For users of IoT-connected devices, GeoZilla collaborates with select IoT device manufacturers to enhance the functionality of the GeoZilla Service by integrating compatible devices. When you connect these devices to GeoZilla, we may receive certain data from our IoT partners that allows us to support key features like emergency alerts. This data is anonymized to protect your privacy and includes the following elements:

  • Anonymized Authorization Token: A unique token is created to establish a secure connection between GeoZilla and the IoT device, allowing identification without exposing personal details.
  • Anonymous Account ID: An anonymous ID links to your account to identify data flows without disclosing personal information, enabling service functionality.
  • SOS Signal: When activated, your IoT device sends an SOS signal to GeoZilla, which alerts your circle members.
  • Tracker ID: An anonymous identifier assigned to each IoT device, allowing GeoZilla to differentiate between devices without revealing user identities.
  • Anonymous Location Data: Location data may be shared for features like emergency alerts, but it is anonymized to avoid linking to specific personal information.

This data is solely used to enable functions within the GeoZilla Service, particularly to trigger SOS alerts and facilitate emergency responses within user circles. GeoZilla does not collect any personally identifying information from these IoT devices and strictly limits data use to maintaining core functionalities.

Legal Grounds for Processing

We process your data primarily for the performance of the contract between you and us (Terms of Use). Exceptions include:

  • Location Data: Collected based on your explicit consent, which you provide by enabling location services in GeoZilla Service. You can withdraw your consent at any time through device settings.
  • Driving Event & Fall Detection Data: Processed based on your consent for these features, which you can withdraw within GeoZilla Service at any time.
  • Advertising Data: Used for behavioral advertising with your consent, which can be withdrawn anytime.
  • Newsletters: We may use your email to send you newsletters based on your consent, which you can revoke at any time through the unsubscribe link in emails.
  • Parental Consent: For processing data of children under 13 (or under 16 in the EU), we obtain parental consent, and data provided by the parent or legal guardian during granting parental consent is processed in accordance with legal requirements.

Access to your Personal Information

We share your Personal Information, including name, email, location, driving event data and fall detection data, with others within your GeoZilla circles.

Any information or content that you voluntarily post to our App Store and Google Play Store, or our social media pages will automatically be available to the public. We may publicly post your reviews and comments online.

We may disclose your Personal Information in some other limited circumstances, but we will specifically describe them to you when we collect the information, such as in the terms of use for a new service or by revising this Privacy Policy.

We may disclose your Personal Information to a third party without your consent if we believe it is necessary to identify, contact, or take legal action against someone causing harm to our rights or property, other users, or any third party. Despite these measures, you should know that GeoZilla cannot fully eliminate security risks associated with Personal Information. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Please also remember, that to protect the communications that have taken place in the app, never give out your password.

Data Retention Period

We will retain your Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. By default, we retain data for 3 years after the last interaction with you, unless your account is deleted earlier. Location data is retained for 2 weeks. Information collected through cookies is retained for the period specified in our Cookie Policy as provided above. When there is no ongoing legitimate business need, we will either delete or anonymize your data, or securely store it until deletion is possible, in compliance with applicable law.

User Information Update and Account Deactivation

If your Personal Information changes, or if you no longer desire the GeoZilla Service, you may email us at support@geozilla.com to deactivate your account. You may also correct, update, or amend your Personal Information in your profile settings within the GeoZilla app or by emailing us. Removing GeoZilla from your mobile device will not delete the Personal Information that has been retained about you. If you leave your circles, we will retain your user content in the event that you would like to access it in the future. Your user content can be deleted permanently by emailing a request to support@geozilla.com.

Management of Communication with GeoZilla

You may “opt out” of receiving marketing or promotional emails from us by following the instructions in those emails or by emailing us at support@geozilla.com. If you opt out, we may still send you non-promotional emails, such as emails about your accounts or our ongoing business relations. To opt out of push notifications, please edit settings within the app or change your settings at the device level.

Governing Law

GeoZilla is a global company based in the United States. If you are accessing GeoZilla from any region with laws or regulations governing personal data collection, use, and disclosure that differ from those in the United States, please be aware that by continuing to use GeoZilla’s services, which are governed by United States law, the GeoZilla Privacy Policy, and the Terms of Use, you consent to the transfer of your Personal Information to the United States.

GeoZilla operates internationally, and as such, your Personal Information may be transferred to, stored, and processed in countries outside your region of residence, including the United States, where data protection laws may differ from those in your country. By using the service, you acknowledge and consent to these international transfers of your data, and agree to be bound by the applicable data protection laws of the United States.
